At DigestionReady®, we are committed to protecting your privacy. This policy explains how Dr David Lovell-Smith and his staff collect, use, store, and protect your personal and health information in accordance with the New Zealand Privacy Act 2020 and the Health Information Privacy Code 2020.

We collect information that is necessary to provide you with our programmes and consultations. This includes:

 

Identity Data: Your full name and date of birth.

Contact Data: Your email address, phone number, and physical address.

Health Information: Medical history, dietary habits, lifestyle details, and any health concerns you share during consultations or in programme forms or surveys.

Transaction Data: Details about payments and the specific programmes you have purchased.

Usage Data: Information about how you interact with our digital course materials and website.

2.  How We Collect Your Information

We collect data directly from you when you:

  • Register for a programme (DigestionReady®, Happy Tummy™, or Ayurveda Consultations)

  • Fill out a health intake form or questionnaire

  • Communicate with us via email, text, surveys, or during Live Webinar Sessions

  • Interact with our website and digital platforms

 

We do not collect information from third parties or use automated data collection tools beyond standard website analytics.

3.  Why We Collect Your Information

Your information is collected and used to:

  • Deliver the educational content and consultations you have purchased

  • Tailor our health coaching to your general needs

  • Process payments and manage your account

  • Communicate updates, support, or relevant health information

  • Comply with New Zealand legal and professional record-keeping obligations

 

We will not use your information for any purpose that is inconsistent with the reason it was collected without first obtaining your consent.

4.  Storage and Security

Your privacy is a priority. We use secure, encrypted cloud-based platforms to store your data. Access to your personal and health information is restricted to Dr Lovell-Smith and authorised staff only.

 

In accordance with New Zealand health information standards, we generally retain health-related records for a minimum of 10 years from the date of your last consultation or interaction with our programmes. Non-health personal data (such as billing records) is retained for a minimum of 7 years as required by New Zealand tax and commercial law.

 

Data Breach

In the event of a privacy breach that poses a risk of serious harm, we are required under the Privacy Act 2020 to notify both the Office of the Privacy Commissioner and the affected individual(s) as soon as practicable.

5.  Disclosure to Third Parties

We do not sell or rent your personal information to any third party under any circumstances.

 

We share information only with trusted service providers who assist us in running our programmes. These may include:

  • Payment processors (e.g. Stripe) for billing and transaction management

  • Email platforms (e.g. Brevo) for programme communications

  • Online course hosting platforms (e.g. Thinkific, GHL) for delivery of digital content

 

All third-party providers are contractually obligated to keep your data secure and to use it only for the specific purpose for which it was shared. We do not permit them to use your data for their own marketing purposes.

 

We may also disclose your information if required to do so by law, or to protect the safety of our participants or others.

6.  International Participants

If you are accessing our programmes from outside New Zealand, please note that your personal and health information will be transferred to and stored in New Zealand. By participating in our programmes, you consent to this transfer.

 

Your information is protected in New Zealand by the Privacy Act 2020. While New Zealand’s privacy framework may differ from that of your home country, it is recognised internationally as providing a high standard of protection for personal data.

7.  Your Rights

Under the Privacy Act 2020 and the Health Information Privacy Code 2020, you have the following rights:

 

Access: You may request a copy of the personal information we hold about you at any time.

Correction: You may ask us to correct any information you believe is inaccurate or incomplete.

Withdrawal of Consent: You may withdraw your consent for us to hold or use your data. Please note that withdrawal may result in the termination of your access to the programmes without refund, as delivery of services requires us to hold certain information.
